Florida seawall permits: who reviews the work

Seawall permitting in Florida is not one process. Depending on the scope and the waterway, up to five different bodies can have an interest in the same wall — and the one that matters most to a homeowner is usually the local one.

The common assumption is that a seawall repair is a construction question with a permit attached. For a significant number of Florida properties it is the other way round: the permitting position determines what the project has to be. A required minimum elevation does not care what you intended to spend, and it can convert a like-for-like rebuild into a larger job.

The second assumption worth dropping is that one answer covers Florida. It does not. The requirements below are what we could source for specific jurisdictions. Where we have not sourced a jurisdiction, this page does not guess at it.

Who can be involved

The municipal building division

Almost always, for a wall on private residential shoreline

This is the review most owners actually experience. Hollywood, for example, adopted its own seawall ordinance rather than relying on the county standard alone, and runs seawall submittals through its own Building Division intake.

The county

Where the county sets a standard the city has to meet or exceed

Broward County sets a countywide minimum tidal flood barrier elevation of 5.0 feet NAVD88 with a transition provision running to 2050. Cities may then go further: Miami Beach requires 5.7 feet NAVD, and Fort Lauderdale raised its minimum to 5 feet NAVD from 3.9.

A city utility or stormwater division

Where the shoreline is part of a managed canal system

Cape Coral has over 400 miles of canal and publishes its own seawall design standards, separating freshwater canal shorelines from tidal ones with rules that are specific and measurable.

The state — or, more often, a water management district

Where an Environmental Resource Permit is engaged

Florida statute exempts seawall restoration from certain state permitting, but the exemption is measured in inches — and neither exemption supersedes permitting requirements under Chapter 161. Where an ERP is engaged, the reviewer is frequently not the Department at all: the Department names the categories it reviews itself, all of them industrial, and states the water management districts review all other ERP applications.

Depending on the waterway

Work in or affecting navigable waters can pull in a federal review. Whether it applies is a function of the waterway and the scope, not of how large the project feels. The Corps publishes its own Florida regulatory route, which is where that question belongs.

Which of these apply to your property is a function of where it is and what the work involves. We have not verified requirements for every Florida municipality and do not publish a requirement we could not source.

The state and federal routes, and who actually reviews

“The state” is the vaguest line on most permitting pages, and it is usually wrong in a specific way. An Environmental Resource Permit is processed by either one of the Department’s six district offices or one of Florida’s five water management districts — St. Johns River, Suwannee River, Northwest Florida, South Florida and Southwest Florida — and the Department states that operating agreements between it and the districts specify which agency processes each type of application.

The categories the Department lists for itself are industrial: waste facilities, mining other than certain borrow pits, and power plants, transmission lines and petroleum infrastructure. It states the water management districts review and take action on all other ERP applications. A residential shoreline is not in the Department’s list, which points at the district rather than at Tallahassee — and the Department says its staff and the districts’ staff will help an applicant work out which agency an application belongs to. That question is answerable before you hire anyone.

There is also a route for the exemption question itself. The Department states that Statewide ERP accepts any type of ERP verification of exemption or permit application online. A verification of exemption is a submittal asking the agency to confirm whether an activity qualifies for an exemption — which is a different thing from a contractor telling you the work is exempt.

One trap worth naming. The Department also runs a self-certification route, and it is narrower than owners assume: the types it lists are single-family docks — a new dock with or without a boat lift, repair or replacement of an existing dock, adding a boat lift — and a general permit for a stormwater management system under stated size limits. A seawall is not among them. Self-certification is not a way to treat a seawall as exempt.

These open on the agency’s own site rather than ours, and we receive nothing if you use them. None of them establishes whether a permit is required for your wall — they are the routes to the bodies that decide that.

Why the elevation number is the one to find first

Of everything in a seawall permit, the required minimum elevation is the item most likely to change the size of the project. A wall that is structurally sound but below a required elevation may still need to be raised when work crosses a substantial-repair threshold, and raising a wall pulls in cap, tieback and sometimes upland work.

That is precisely the point at which a repair conversation becomes a replacement conversation — the fork is set out in full on the repair-or-replace page. It is also the reason it is worth establishing the permitting position before accepting a quote rather than after: a quote written against the wrong scope is not a cheaper project, just a shorter document.

These are published ranges, not quotes, and they cover the permit rather than the work. Engineering, inspection and the construction itself are separate lines — the cost page sets out how far apart the published construction figures are and why.

What to establish before you sign anything

  • Which body reviews shoreline work at your address, and whether the city has its own ordinance layered on the county standard.
  • The minimum elevation that applies to you, and whether your existing wall meets it.
  • Whether your intended scope crosses a substantial-repair threshold, because that is what can trigger the elevation requirement.
  • Whether the design must be prepared by a registered engineering professional, and whether what you have been handed is an engineered design or a contractor’s scope.
  • Who is pulling the permit. A contractor who wants you to pull it as an owner-builder is telling you something — the contractor page covers why that matters.

A Florida Environmental Resource Permit is not always reviewed by the state. It is processed either by a Department district office or by one of the five water management districts, and which one is set by agreement rather than by the applicant.

  • The department states that Environmental Resource Permit applications and state-owned submerged lands authorizations are processed by either one of the department's six district offices or one of Florida's five water management districts: St. Johns River, Suwannee River, Northwest Florida, South Florida and Southwest Florida.

Read carefully: A residential shoreline project is not one of the categories the department lists for itself, which points to the water management district — but the operating agreements govern, and the department offers to help determine the agency. Establish the reviewing agency for your address before assuming one. This says nothing about whether your particular work needs an ERP at all.

The state runs its own online route for asking whether work is exempt, so an owner does not have to take a contractor's word for the permitting position.

  • The department states that Statewide ERP allows users to submit any type of ERP verification of exemption or permit application online, with the option to apply for a State 404 Program authorization at the same time, to upload supporting documents and to pay processing fees online.

  • The department's self-certification route is narrower than owners often assume: the types it lists are single-family docks — new dock with or without a boat lift, repair or replacement of an existing dock, addition of a boat lift — and a general permit for a stormwater management system under stated size limits.

Read carefully: The self-certification types the department lists are docks and stormwater. A seawall is not among them, so self-certification is not a route to treat a seawall as exempt. Asking for a verification of exemption is a submittal to an agency, not a form that returns an answer immediately.

Read carefully: This is a route to the federal regulator and nothing more. The page carries no statement about seawalls, so it establishes no federal requirement, no exemption and no general permit. Whether federal review applies to your work is a question for the Corps.

  • Section 403.813(1)(e) exempts "the restoration of seawalls at their previous locations or upland of, or within 18 inches waterward of, their previous locations."
  • Section 403.813(1)(o) exempts the construction of private seawalls in wetlands or other surface waters when the construction is between and adjoins at both ends existing seawalls, follows a continuous and uniform seawall construction line with the existing seawalls, is not more than 150 feet in length, and does not violate existing water quality standards, impede navigation, or affect flood control.

Read carefully: An exemption from one agency is not an exemption from all of them. A project can be exempt under 403.813 and still require city, county, water management district or Army Corps authorisation.

Broward County sets a countywide minimum tidal flood barrier elevation of 5.0 feet NAVD88, with a transition provision that runs to 2050.

  • Tidal flood barriers shall have a minimum elevation of five (5) feet NAVD88.

Read carefully: The 4-foot figure is a conditional transition allowance, not an alternative standard. It is only available where the barrier is designed and built to be raised to 5 feet by 2050.

  • In January 2021 the City strengthened a 2016 policy into an ordinance requiring new seawalls at 5.7 feet NAVD and requiring failing seawalls to be rebuilt to that minimum.

Read carefully: Crossing a municipal line in South Florida can change the required elevation. Miami Beach at 5.7 feet NAVD and Broward at 5.0 feet NAVD88 are different numbers on different data.

Do I need a permit to repair my seawall in Florida?
Assume yes and confirm locally. Florida statute exempts seawall restoration from certain state permitting, but that exemption is measured in inches and does not remove local review. The municipal building division is the review most residential owners actually encounter, and several Florida cities run seawall submittals through their own dedicated intake.
Does the statutory exemption mean no permit at all?
No. The exemption is narrow, it is dimensional rather than general, and it does not supersede permitting requirements under Chapter 161. A repair that stays inside the exemption for state purposes can still require local review, and the local review is where elevation requirements live.
What elevation will my seawall have to meet?
It depends on the municipality, and the differences are real rather than technical. If the question is whether your work is exempt, the Department’s route for that is a verification of exemption, which is a submittal to the agency rather than a self-declaration.
What does seawall permitting cost?
Published permit figures we could find run roughly $500 to $2,000 as a general range, with a separate South Florida range reported at $1,500 to $6,000. Those are published ranges rather than quotes, and permitting is one line in a project, not the project.
Who prepares the design that gets submitted?
Where a jurisdiction requires it, a registered engineering professional. Cape Coral, for instance, has seawalls designed by registered engineering professionals and reviewed, permitted and inspected on completion. A contractor quoting a scope is not the same thing as an engineer specifying one, and it is worth knowing which you have been given.
